Terms of Service

Effective September 14, 2026

These Terms of Service (the Terms) form a legal contract between you (you or Customer) and Bypassify (Bypassify, we, us, or the Company). By creating an account, downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Section 18 contains a mandatory binding-arbitration agreement and a class-action waiver. By using the Service, you agree that disputes between you and Bypassify will be resolved individually in arbitration, and not by a court of general jurisdiction or as part of a class or representative proceeding, except as expressly provided in that section.

1. Definitions

For clarity throughout these Terms:

Service
Collectively, the Bypassify software applications, the associated backend infrastructure, launcher and installer tooling, the website at bypassify.com, and any related documentation, updates, and support we provide.
Account
The email- and password-authenticated identity we associate with your subscription.
Device
A single physical computer identified by a stable hardware identifier and bound to a Bypassify session.
Subscription
A paid plan (Basic or Pro, monthly or lifetime, as applicable) that grants Access to specified features of the Service.
Content
Any text, prompts, screenshots, images, audio, or other material you submit to, capture through, or generate with the Service.
AI Providers
Third-party artificial-intelligence services that we use to process prompts and produce responses on your behalf.
Prohibited Party
Any individual or entity described in Section 8 — most notably employees, agents, contractors, or affiliates of a Vendor purchasing on behalf of, at the direction of, or for the benefit of that Vendor.
Vendor
A company that develops, licenses, distributes, or maintains examination-security, remote-proctoring, or browser-lockdown software, together with any of that company's affiliates, successors, and licensees.

2. Accounts and eligibility

2.1 Age. You must be at least eighteen (18) years old to create an Account and use the Service. By registering, you represent that you meet this age requirement.

2.2 Accurate information. You will provide accurate, current, and complete registration information (including a working email address) and keep it accurate throughout your use of the Service.

2.3 Account security. You are responsible for maintaining the confidentiality of your credentials and for every activity that occurs under your Account.

3. The Service

3.1 What we provide. Bypassify provides on-device software that overlays an AI-powered assistant on top of your regular workflow, together with a paid API relay through which the assistant sends prompts to third-party AI Providers and returns their responses. The specific clients we make available, the platforms they target, and the features included on each plan are as described in your Account and at bypassify.com from time to time.

3.2 Updates and changes. We may update, modify, or discontinue any part of the Service — including individual clients, features, model availability, or compatibility with third-party environments — at any time and without prior notice, provided that we will not make material adverse changes to paid Subscription features without reasonable notice, except where required by law, safety, or a third-party dependency.

3.3 Compatibility. Compatibility with specific operating-system versions, third-party applications, and hardware configurations is provided on a best-effort basis and is not guaranteed. Our published "Bypass Status" page reflects our current best information but is not a warranty.

4. Subscriptions and billing

4.1 Plans. The Service is offered on the plans described at bypassify.com and in your Account. Plan pricing, billing cadence, and included features are as displayed at the time of purchase.

4.2 Payment processor. Payments are processed by a third-party payment processor. By subscribing, you authorize that processor to charge your designated payment method for the applicable Subscription fees, taxes, and any authorized additional charges, and you agree to that processor's terms and privacy policy in your capacity as its end-user.

4.3 Auto-renewal. Recurring Subscriptions automatically renew at the end of each billing period at the then-current price for the same plan unless you cancel prior to the renewal date through your customer portal or by contacting us. Cancellation takes effect at the end of the current paid period; you will retain access through that date.

4.4 Taxes. Prices are exclusive of applicable taxes. You are responsible for any sales, use, VAT, GST, or similar taxes assessed on your Subscription, other than taxes imposed on our net income.

4.5 Refunds. Except where required by applicable consumer-protection law, all Subscription fees are non-refundable. Because the Service delivers digital content immediately upon subscription, you expressly waive any right of withdrawal or "cooling-off" period to the maximum extent permitted by law.

4.6 Failed payments. If a scheduled charge fails, we may (i) retry the charge, (ii) place your Subscription in a past-due state that suspends access to paid client features while preserving your Account and dashboard, and (iii) after a reasonable dunning period, cancel the Subscription. You remain liable for authorized amounts.

5. Upgrades, promo codes, and the upgrade fee

5.1 Basic-to-Pro upgrade. When you elect to upgrade from Basic to Pro, we charge (a) a one-time upgrade fee as displayed at checkout and (b) the recurring Pro Subscription fee going forward. Any promotional discount applied at checkout is governed by the terms displayed with that promotion.

5.2 Basic sub cancellation on upgrade. Upon completion of a Basic-to-Pro upgrade, we will cancel your Basic Subscription automatically. Cancellation is effective on the date the upgrade is processed; time remaining on the Basic term is not credited or refunded, and Pro access supersedes Basic from that date forward.

5.3 Promo codes. Promotional codes are void if obtained through fraud, use in violation of these Terms, or use in circumstances the promotion did not contemplate. We may cancel any Subscription obtained through such misuse and reclaim any resulting entitlement.

6. License grant

Subject to your ongoing compliance with these Terms and payment of applicable fees, Bypassify grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service on Devices you own or lawfully control, solely for your own personal, non-commercial use.

All rights not expressly granted are reserved to Bypassify. Nothing in these Terms conveys any ownership interest in the Service to you.

7. Acceptable use

You will not, and will not permit any other person to:

  1. use the Service to violate any applicable law, court order, or contract you owe to a third party;
  2. use the Service to commit fraud, misrepresent your identity, or violate the academic-integrity or examination rules of any institution to the extent doing so would violate law;
  3. resell, redistribute, sublicense, rent, lease, or otherwise commercially exploit the Service, your Account, or any Content delivered through the Service;
  4. share, transfer, or lend your Account credentials to any other person, or knowingly permit another person to use your Subscription;
  5. use the Service to build, train, or improve a competing product or service, or to develop machine-learning models on Service outputs (except as expressly permitted by the applicable AI Provider's terms);
  6. interfere with, disrupt, or attempt to gain unauthorized access to the Service, our infrastructure, or the systems of our AI Providers, payment processor, or hosting providers;
  7. circumvent, disable, or attempt to defeat any technical protection, license check, session-binding mechanism, rate limit, or usage measurement in the Service;
  8. submit Content that infringes another's intellectual-property rights, discloses another person's private information without authorization, contains malware, or violates any applicable law; or
  9. use the Service to generate content that sexually exploits minors, incites imminent violence, facilitates a violent extremist attack, or that any AI Provider's usage policies prohibit.

Violation of this Section 7 is grounds for immediate suspension or termination under Section 14 and forfeiture of any prepaid fees.

8. Competitor and vendor purchases

8.1 Representation and warranty. By creating an Account, subscribing, or using the Service, you represent and warrant that:

  1. you are a natural person purchasing the Service in your individual capacity, and not on behalf of, at the direction of, for the benefit of, or in the course of employment or contract with a Vendor or any other Prohibited Party;
  2. you are not an employee, officer, director, agent, contractor, consultant, seat-holder, or affiliate of any Vendor at the time of Account creation, subscription, or use;
  3. you are not conducting research, testing, reverse engineering, security analysis, vulnerability disclosure, competitive intelligence, or evidence-gathering on the Service on behalf of any Vendor, litigant, government agency, or law-enforcement body; and
  4. you are not using any employer-provided device, employer network, employer time, employer credit card, or other employer resource to acquire or use the Service if that employer is a Vendor.

8.2 Consequences of false representation. If any representation in Section 8.1 is or becomes false at any time, then:

  1. the license in Section 6 is void ab initio — treated as if never granted — and any use of the Service by you from the date of the false representation forward is unauthorized access to a protected computer system within the meaning of applicable federal and state computer-fraud law;
  2. Bypassify may immediately terminate your Account, revoke all associated entitlements, and retain all fees paid as liquidated damages, which the parties agree are a reasonable estimate of the damages that would otherwise be difficult to quantify;
  3. you and your employer or principal (if any) will jointly and severally indemnify Bypassify for all costs, fees, expenses, and damages arising from or related to the unauthorized use; and
  4. you waive, on behalf of yourself and, to the fullest extent permitted by law, on behalf of the Vendor or Prohibited Party for whom you acted, any and all claims against Bypassify arising out of or relating to the Service or your acquisition of it.

8.3 Employer-purchase covenant. If you purchase or use the Service using employer resources or during employment with a Vendor, you represent that you have your employer's express authorization to (a) enter into these Terms in the employer's name and (b) bind the employer to these Terms, and — regardless of whether such authorization exists — you personally guarantee performance of all obligations you and the employer owe under these Terms.

8.4 Estoppel. The parties intend Sections 8.1–8.3 to operate as an estoppel: no Vendor or Prohibited Party that acquires access to the Service through an agent — whether authorized or not — may later assert claims against Bypassify predicated on facts that would have been prevented by truthful application of Section 8.1.

9. Reverse engineering, tampering, and revocation

9.1 Prohibited technical acts. Except to the minimum extent expressly permitted by applicable law that cannot be waived by contract, you will not:

  1. reverse engineer, decompile, disassemble, unpack, deobfuscate, or otherwise attempt to derive source code, protocols, algorithms, keys, tokens, or trade secrets from any part of the Service, including any client component or backend endpoint;
  2. modify, adapt, translate, patch, port, or create derivative works of the Service or any of its components;
  3. extract, copy, or capture the Service's software for redistribution, republication, or resale;
  4. circumvent, remove, disable, defeat, or interfere with any license check, session binding, hardware identifier check, rate limit, telemetry, or update mechanism; or
  5. use tools, scripts, or automation to systematically probe, benchmark, or map the Service's protection surface.

9.2 Revocation on suspicion. We may, at our sole discretion and without prior notice, suspend or revoke access for any Account we reasonably believe has engaged in, planned, or facilitated any act described in Section 9.1 or Section 7. We may also revoke access where we reasonably believe an Account was acquired with the intent to reverse engineer, resell, defeat protections, transfer to a Prohibited Party, or otherwise use the Service in violation of these Terms.

9.3 No obligation to refund. A revocation under this Section 9 is not a breach by Bypassify and does not entitle you to any refund of fees paid.

10. Devices, sessions, and switching

10.1 One active Device. Each Subscription may be actively bound to one Device at a time on a given platform. Concurrent use of the Service on multiple Devices under the same Subscription and platform is not permitted.

10.2 Cross-platform. If your plan grants entitlements on both macOS and Windows, you may hold one active Device on each platform.

10.3 Switching cooldown. To limit account sharing, we impose a rolling 14-day cooldown between switches of the active Device for a given plan. You may request a cooldown override for good cause (device loss, theft, hardware failure) through our Discord support server; grants are at our discretion.

10.4 Session lifecycle. We may revoke a session — signing you out of the client and requiring re-authentication — when we detect a password change, cross-platform switch past cooldown, Subscription cancellation, payment failure, or possible token compromise.

11. AI content and usage limits

11.1 Output is not advice. The Service uses large language models to generate responses to your prompts. Outputs may be inaccurate, incomplete, or fabricated. You are solely responsible for reviewing outputs before relying on them. Outputs do not constitute legal, medical, financial, academic, or professional advice.

11.2 Your responsibility. You are solely responsible for (a) the Content you submit to the Service and (b) how you use outputs. Do not submit content you are not authorized to share with our AI Providers under their usage policies.

11.3 Ownership. Subject to third-party AI Provider terms, as between you and Bypassify, you own the prompts you submit and the outputs generated in response to those prompts. You grant Bypassify a worldwide, non-exclusive, royalty-free license to process your prompts and generate outputs solely to provide the Service, to enforce these Terms, and to comply with law.

11.4 Quotas. The Service enforces a daily message limit per Subscription entitlement (currently 400 messages per day, subject to change). Quotas reset at midnight UTC and are not carried over.

11.5 Screen capture. The Service may capture screenshots at your direction and send them to the applicable AI Provider for processing. You are solely responsible for the contents of any screenshot you capture and for whether capturing the material in question is lawful in your jurisdiction and consistent with any applicable third-party terms.

12. Intellectual property

12.1 Bypassify property. The Service and all associated software, source code, object code, documentation, designs, trademarks, service marks, logos, and know-how are the exclusive property of Bypassify and its licensors, protected by U.S. and international intellectual-property law. Your use of the Service does not transfer any of these rights to you.

12.2 Feedback. If you send us suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback into the Service without obligation or compensation to you.

12.3 Trademarks. "Bypassify" and the Bypassify logo are trademarks of the Company. All other trademarks are the property of their respective owners.

13. Third-party services

The Service depends on and integrates with third-party providers in the categories of authentication, database, payments, hosting, network delivery, and artificial-intelligence processing. Your use of these providers through Bypassify is subject to their applicable terms and privacy policies. Bypassify is not responsible for third-party services or the availability, accuracy, or reliability of anything they provide.

14. Suspension and termination

14.1 By you. You may cancel your Subscription at any time through the customer portal accessible from your dashboard. Cancellation takes effect at the end of the then-current paid period.

14.2 By us for cause. We may suspend or terminate your Account and Subscription immediately, without prior notice or refund, if we reasonably believe you have breached Sections 7, 8, or 9, or any other material provision of these Terms; if required to comply with law or a valid legal request; or if your continued access poses a security or fraud risk.

14.3 By us for convenience. We may discontinue the Service in whole or in part on reasonable notice. Where we do so for our convenience during a prepaid term, we will provide a prorated refund of unearned Subscription fees.

14.4 Effect of termination. On termination: (a) your right to use the Service ends immediately; (b) we may delete your Account data in accordance with Section 5 of the Privacy Policy; (c) Sections that by their nature should survive (including Sections 6, 8, 9, 11, 12, 15, 16, 17, 18, 19, and 21) survive termination.

15. Disclaimers

The service is provided "as is" and "as available," with all faults and without warranty of any kind. To the maximum extent permitted by law, Bypassify disclaims all warranties, express, implied, statutory, and otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, will continue to be compatible with any particular third-party environment, or will produce accurate results. No advice or information obtained from Bypassify creates any warranty not expressly stated in these Terms.

16. Limitation of liability

To the maximum extent permitted by law, in no event will Bypassify, its officers, directors, employees, contractors, agents, licensors, service providers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, loss of goodwill, business interruption, loss of academic or professional standing, disciplinary action, loss of employment, or the cost of substitute services, arising out of or relating to these Terms or the Service, whether in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Bypassify has been advised of the possibility of such damages.
To the maximum extent permitted by law, Bypassify's aggregate liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) one hundred U.S. dollars ($100.00 USD) or (b) the total fees you paid to Bypassify for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the exclusions and limitations above apply to the maximum extent permitted.

17. Indemnification

You will indemnify, defend, and hold harmless Bypassify and its officers, directors, employees, contractors, agents, licensors, service providers, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Content or your use of the Service; (b) your breach of these Terms, including without limitation any breach of the representations and warranties in Section 8; (c) your violation of any law or of the rights of any third party; or (d) any dispute between you and a third party related to your use of the Service.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to your indemnification; in that event, you will cooperate with us as reasonably requested.

18. Binding arbitration and class-action waiver

18.1 Agreement to arbitrate. You and Bypassify agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, the Service, any prior version of the Service, or the relationship between you and Bypassify — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether the claim arose before, during, or after termination — will be resolved exclusively by final and binding individual arbitration, and not in a court of general jurisdiction, except as expressly provided below.

18.2 Governing arbitration act. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq., and evidences a transaction involving interstate commerce.

18.3 Administrator and rules. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, as modified by these Terms. If AAA is unavailable, the parties will select a comparable administrator. AAA rules are available at adr.org.

18.4 Location and format. Arbitration will take place at a location mutually agreed by the parties, or — if the parties cannot agree — at a location designated by AAA. For consumer claims under $25,000 USD, arbitration will proceed by telephone, video conference, or documents-only submission at your election.

18.5 Arbitrator's authority. The arbitrator has exclusive authority to resolve any dispute over the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of it is unenforceable, unconscionable, void, or voidable. The arbitrator may award any relief that a court of competent jurisdiction could award, including declaratory or injunctive relief, but only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

18.6 Class-action waiver. You and Bypassify agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, mass, or representative proceeding. Unless both parties agree in a signed writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If this class-action waiver is found unenforceable, then the entirety of Section 18 will be null and void, but the remainder of these Terms will remain in full force and effect.

18.7 Small-claims carve-out. Notwithstanding Section 18.1, either party may bring an individual action in small-claims court (or the equivalent) if the claim qualifies and remains in that court.

18.8 IP carve-out. Notwithstanding Section 18.1, either party may seek injunctive or other equitable relief in a court of competent jurisdiction (see Section 19) to prevent actual or threatened infringement or misappropriation of that party's intellectual-property rights.

18.9 Costs. Filing, administration, and arbitrator fees will be allocated in accordance with the AAA Consumer Arbitration Rules. Each party bears its own attorneys' fees, except where a statute or the arbitrator's award provides otherwise.

18.10 Survival. This Section 18 survives any termination of these Terms or your Account.

19. Governing law and venue

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the state in which Bypassify maintains its principal place of business and the applicable federal laws of the United States, without regard to conflicts-of-law rules. The parties disclaim the application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act.

Subject to Section 18, exclusive jurisdiction and venue for any court proceeding permitted under these Terms (including proceedings to compel arbitration, enforce an arbitration award, or obtain the relief described in Sections 18.7 or 18.8) lies in the state and federal courts having jurisdiction over the location of Bypassify's principal place of business, and each party consents to personal jurisdiction there and waives any objection based on forum non conveniens.

20. Changes to these Terms

We may modify these Terms from time to time. If we make a material change, we will provide reasonable notice — for example, by email to the address on file with your Account, by a banner in the dashboard, or by an in-client notice — before the change takes effect. Continued use of the Service after the effective date of an amendment constitutes acceptance of the amended Terms. If you do not agree, your sole and exclusive remedy is to cancel your Subscription and stop using the Service.

21. Miscellaneous

21.1 Entire agreement. These Terms, together with the Privacy Policy and any other legal notices we publish that reference these Terms, constitute the entire agreement between you and Bypassify regarding the Service and supersede all prior agreements and understandings.

21.2 No waiver. A failure or delay by Bypassify to exercise any right under these Terms is not a waiver of that right.

21.3 Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be modified only to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. If the class-action waiver in Section 18.6 is held unenforceable, Section 18 as a whole is severed as described therein.

21.4 Assignment. You may not assign or transfer these Terms or your Account, in whole or in part, without our prior written consent; any purported assignment in violation of this section is void. Bypassify may assign these Terms freely, including in connection with a merger, acquisition, financing, or sale of assets.

21.5 Force majeure. Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including without limitation acts of God, war, terrorism, civil unrest, pandemic, labor action, act of any government or regulator, denial of service by a third-party provider, or failure of the internet or a telecommunications carrier.

21.6 Relationship of the parties. These Terms do not create any agency, partnership, joint venture, or employment relationship.

21.7 Notices to you. We may provide notices to you by posting in the customer dashboard, by in-client notice, or by any other means we reasonably choose.

21.8 Notices to us. Legal notices to Bypassify must be delivered through the Bypassify Discord support server and directed to a Bypassify staff member, who will confirm receipt.

21.9 Export controls. You will comply with all applicable export-control laws, including without limitation those of the United States, and you represent you are not located in, or a resident or national of, any country subject to a U.S. Government embargo, and you are not on any U.S. Government list of prohibited or restricted parties.

21.10 U.S. government end users. The Service is "commercial computer software" as defined in FAR 12.212. U.S. Government end users acquire only those rights set forth in these Terms.
